HB 485 CS (2004) -  Rehabilitation of Contaminated Sites

Increases the tax credit for rehabilitation of drycleaning-solvent-contaminated sites and brownfield sites in designated brownfield areas; increases the maximum amount that a tax credit applicant, or multiple tax credit applicants working jointly to clean up a single site, may be granted per year in tax credits for each site voluntarily rehabilitated; increases the total annual amount of contaminated site rehabilitation tax credits allocated by the Department of Environmental Protection; increases the amount of the contaminated site rehabilitation tax credit; increases the maximum amount that a tax credit applicant, or multiple tax credit applicants working jointly to clean up a single site, may be granted per year in tax credits for each site voluntarily rehabilitated; increases the total annual amount a municipality, county, or other tax credit applicant which voluntarily rehabilitates a site may receive per year in tax credits which it can subsequently transfer to specified entities; increases the total amount of tax credits which may be granted annually; revises the definition of "eligible business" with respect to brownfield redevelopment bonus refunds; authorizes the Office of Tourism, Trade, and Economic Development to waive the fixed capital investment requirement for an eligible business for specified projects; provides conditions and requirements with respect to such waiver; revises the definition of "brownfield sites"; revises a condition under which a local government is required to designate a brownfield area; revises a required component of a brownfield site rehabilitation agreement; revises a requirement of a contractor performing site rehabilitation program tasks; revises contractor requirements that must be certified to the Department of Environmental Protection; revises and provides additional insurance requirements; revises terminology with respect to eligibility to participate in the brownfield rehabilitation program; provides immunity from liability for a county for preexisting soil or groundwater contamination of a property that escheats to the county; authorizes a county and the department to enter into a written agreement for the performance, funding, and reimbursement of investigative and remedial acts necessary for a property that escheats to the county; revises provisions with respect to the investment of specified funds under the Brownfield Areas Loan Guarantee Program; provides that such funds shall be derived from the Inland Protection Trust Fund rather than the Nonmandatory Land Reclamation Trust Fund; revises certain restrictions on the investment of such funds; provides for future legislative review of the Brownfield Areas Loan Guarantee Program.
