Provides for grandfathering and modification of certain rights of a unit owner; provides for certain application of the amendment of unit owner's rental rights; requires certain voting and approval criteria for amendments depriving owners of certain rights; creates the Office of the Condominium Ombudsman within the Division of Florida Land Sales, Condominiums, and Mobile Homes; requires the division to fund the office; requires the Department of Business and Professional Regulation to provide administrative support and service to the office; authorizes the Governor to appoint the ombudsman; requires the ombudsman to be an attorney admitted to practice before the Florida Supreme Court; provides for the filling of vacancies in the office; requires the ombudsman and staff to subscribe to the oath of office required of state officers; prohibits an officer or full-time employee of the office from engaging in any other profession, serving as a representative or employee of any political party, or receiving remuneration for activities on behalf of political candidates; prohibits the ombudsman and his or her staff from seeking public office unless resigned from the office; grants certain powers and duties to the ombudsman; authorizes the ombudsman to adopt and administer a personnel classification system and pay plan for office employees with the approval of the Office of the Governor; authorizes the division to remove a member of a condominium board under certain circumstances; authorizes the division, in consultation with the ombudsman, to adopt rules with respect to such removal; provides that the ombudsman is not required to provide counsel or witnesses, or other assistance, at public expense; provides for the location of the ombudsman's office; creates the Advisory Council on Condominiums; provides for appointments by the President of the Senate, the Speaker of the House of Representatives, and the Governor; provides limited compensation; provides for membership, functions, , terms of service, meetings, and offices of the advisory council; provides certain prospective unit buyers with a separate document, rather than a separate page, of frequently asked questions and answers; reduces the threshold amount to be required to be disclosed in controversy for litigation; preserves the department's authority to pursue certain remedies; provides an appropriation.
