HB 1655 CS (2004) -  Health Care Advance Directive and Blood-Type Recordation

Provides a fee for persons applying for an identification card who chose to participate in the health care advance directive and blood-type registry; provides a fee for persons applying for a driver's license who chose to participate in the health care advance directive and blood-type registry; provides a fee for persons participating in the health care advance directive and blood-type registry; provides required uses for funds generated by the fee; requires the Agency for Health Care Administration and the Department of Highway Safety and Motor Vehicles to develop and implement a voluntary program for health care advance directive and blood type recordation; requires certain health care workers to confirm a principal's blood type; provides for noting an individual's blood type and directive relative to life-prolonging procedures on the individual's driver's license or identification card upon request; requires the Division of Driver Licenses offices to make forms available to the public; requires forms to be accessible electronically on the Internet; requires forms to contain certain information; requires the department to distribute forms for the indication of health care directives and blood type; provides a recordkeeping system; requires the agency to provide funds for supplies; requires the department to provide funds for the recordkeeping system; provides funding for recordkeeping from the department; provides supply funding from the general revenue of the agency; establishes a health care advance directive and blood-type registry; requires the department to collect data and provide collected data to the agency for the registry; requires the registry to record advance directive and blood type information; provides access to the registry by certain persons; provides guidelines for the processing of forms; provides criteria for revocation or amendment of registry information by certain individuals; provides for registering documents with the registry; provides criteria for health care advance directives being submitted; requires the department and the agency to develop and implement a living will registry; provides means to amend or revoke a health care advance directive or blood type from the registry; creates responsibility of principal to update forms; provides standards for controlling forms and recordings; provides health care workers with civil and criminal immunity from acts done in concert with certain information provided by the department; requires the agency, subject to the concurrence of the department, to develop a continuing education program relating to health care advance directives and the health care advance directive and blood-type registry; provides for appointment of an education panel to create an end-of-life public education campaign; provides campaign criteria; provides contractual power for programs aimed at educating certain medical professionals; requires a study to be conducted by the agency.
