Health Care Advance Directives: Revises the definition of "incapacity" or "incompetent"; clarifies requirements on palliative care; clarifies a principal's statement of understanding in suggested form for designation of health care surrogate; eliminates the requirement for written notification for health care surrogates by a health care facility; clarifies that a surrogate cannot override a principal's wishes as expressed in a living will; provides a standard for a surrogate's decisionmaking under certain circumstances; requires the Division of Driver Licenses offices to make forms available to the public; requires the Department of Highway Safety and Motor Vehicles and the Agency for Health Care Administration to make sample forms accessible electronically on the Internet; provides certain health care employees with civil and criminal immunity from acts performed in conjunction with certain information indicated by the department; expresses the sovereign immunity of the department and its employees from criminal prosecution and civil liability for certain acts; authorizes certain individuals or business entities to act as a proxy; corrects a typographical error.
