HB 1439 (2005) -  Red Light Violations

Creates the "Mark Wandall Traffic Safety Act"; provides for a county or municipality to enforce a traffic control signal steady red light indication using a traffic control photographic system; provides system capability, design, and implementation requirements; provides for citation of the motor vehicle owner; provides for a civil fee; provides for distribution of moneys collected; requires payment of a civil fee; provides for exceptions; prohibits dual enforcement; provides for citation and enforcement; provides for additional fees and costs of collection to be paid; provides for distribution of such fees and costs collected; provides procedures and grounds for appeal of citation; provides for admissibility of recorded images as evidence of violation; exempts local enforcement under the act from certain civil traffic penalty restrictions; exempts local enforcement under the act from certain traffic infraction enforcement procedures; revises the definition of the term "habitual traffic offender" to include a certain number of violations of traffic control signal steady red light indication within a certain timeframe.
Effective Date: upon becoming a law.
