HB 565 (2006) -  Financial Responsibility of Physicians and Osteopathic Physicians

Provides additional licensure requirements for professional liability insurance coverage, an escrow account, and an irrevocable letter of credit; revises the amounts required through the escrow account or letter of credit; provides for submittal, to the Department of Health, by a physician or an osteopathic physician of a sworn statement and documentation relating to the liability insurance coverage, the escrow account, or the letter of credit; provides for notification of the department by a bank or savings association when the escrow account is closed or transferred or the letter of credit is canceled or expires; removes provisions governing license suspension following cancellation or nonrenewal of professional liability insurance; provides for notification of the department and requires a sworn statement by the physician or osteopathic physician when the professional liability insurance is canceled or not renewed, the escrow account is closed or transferred, or the letter of credit is canceled or expires; provides for license suspension following such termination of insurance, escrow account, or letter of credit; provides criminal penalties for a physician or an osteopathic physician who fails to submit a required notice or statement, who knowingly makes a false declaration in the sworn statement, or who fails to timely file the sworn statement; removes provisions authorizing a physician or osteopathic physician to be exempt from the financial responsibility requirements upon posting notice and meeting certain other criteria; provides that requirements previously applicable to self-insured physicians and osteopathic physicians apply to all such physicians who are required to maintain financial responsibility; requires that a physician or osteopathic physician satisfy an adverse final judgment within a specified period unless otherwise agreed to in writing; provides that a physician or osteopathic physician is not relieved from his or her obligation to satisfy the entire amount of a judgment or award; requires the department to suspend the license of a physician or osteopathic physician upon the mailing of a notice of failure to satisfy an adverse final judgment; provides an exemption for certain physicians or osteopathic physicians for payment to a judgment creditor; requires the department to verify that a physician or osteopathic physician has met financial responsibility requirements before granting or renewing a license; requires the Board of Medicine and the Board of Osteopathic Medicine to adopt rules.
