HB 1299 - Areas of Critical State Concern
GENERAL BILL   by Sorensen (CO-SPONSORS) Russell
Areas of Critical State Concern: Authorizes the continued levy of the tourist impact tax for a specified time in areas of critical state concern removed from designation; provides for continued levy beyond that period pursuant to referendum approval of an ordinance reauthorizing the levy; authorizes counties to continue the use of a portion of local government infrastructure surtax proceeds for public purposes for a specified period after removal of designation of an area as an area of critical state concern; provides for continued use of a portion of such proceeds for specified purposes pursuant to ordinance; provides requirements, procedures, and criteria for Administration Commission removal of designation of the Florida Keys Area as an area of critical state concern; requires removal of the designation under specified circumstances; provides for judicial review of Administration Commission determinations; requires the state land planning agency to review local comprehensive plans and amendments applicable to the Florida Keys Area for compliance with specified requirements; revises powers of a land authority in an area of critical state concern to acquire property to provide affordable housing; provides for continued power of a land authority to acquire property within an area of critical state concern removed from designation; provides for the continued existence of a land authority in an area of critical state concern after removal of the designation; authorizes local governments in areas of critical state concern removed from designation to continue to enact ordinances relating to central sewerage systems; provides for continuation of existing state liability in inverse condemnation actions related to the Florida Keys Area after removal of designation.
