CS/HB 467 - Spousal and Child Support
GENERAL BILL   by Health Care Services Policy Committee and Flores (CO-SPONSORS) Gibson; Zapata; RECOMMENDED by Health Care Services Policy Committee
Spousal and Child Support: Requires specified findings if deferred payment is ordered in equitable distribution; provides requirements for child support & income deduction orders relating to termination of support; specifies how payments on alimony or spousal support are applied; provides for enforcement of interest on child support & alimony or spousal support; requires specified findings to impute income beyond minimum wage; revises provisions relating to income tax calculations to determine net income; provides that certain percentages used for combined monthly net income greater than guidelines schedule shall not be used to determine child support beyond child's reasonable needs; eliminates reduction in child care cost added to basic support obligation; provides for determination of total minimum child support need; provides for payment of parent's share of minimum total child support need; provides for adjustment of minimum child support when application of guidelines leaves party with net income lower than federal poverty level; revises percentage of overnight time-sharing that is considered significant for certain purposes; allows party to be ordered to waive IRS dependency exemption for child for good cause shown; provides that interest shall not accrue on postjudgment interest.
