Exempts from public records requirements information & records reported to DOH under electronic system for monitoring dispensing of certain controlled substances; authorizes certain persons & entities access to information; provides restrictions on use of such information & criminal penalties for violations; authorizes agreements with other states to exchange prescription drug monitoring information; provides factors for considering such agreements; requires report concerning any such agreements; limits purposes for which information may be shared under such agreements; provides for future legislative review & repeal; provides finding of public necessity.
Effective Date: July 1, 2009, if HB 583 or similar legislation establishing an electronic system for monitoring the dispensing of controlled substances listed in Schedule II, Schedule III, and Schedule IV is adopted in the same legislative session or an extension thereof and becomes law
