General Bill
Direct-Mail Marketing Solicitations:
Requires DOACS to establish & maintain by specified date statewide "do not mail" registry to contain list of consumers who do not wish to receive direct-mail marketing solicitations; provides procedures by which person may place name on registry; requires DOACS to provide registry to direct-mail marketer upon request; requires marketer to provide certain information & pay fee established by rule; prohibits direct-mail marketer from mailing solicitations to persons on do not mail registry; requires DOACS to investigate complaints; provides that DOACS or AG's office may bring action to impose civil penalty & seek other relief, including injunctive relief, as court deems appropriate against direct-mail marketer; limits civil penalty imposed; provides that violation of act is deceptive or unfair trade practice; provides penalties; provides that person who receives more than one solicitation within 12-month period by or on behalf of same direct-mail marketer in violation of law may bring civil action for damages, injunctive relief, punitive damages, & reasonable costs & attorney's fees; provides for attorney's fees under certain circumstances.
