Debt Settlement: Creates "Debt Settlement Services Act"; requires that person be licensed in order to provide or offer debt settlement services to client residing in state; provides exceptions to application of act; provides for application form; requires fee & proof of insurance policy or surety bond; requires debt settlement advisor to notify OFR of change of license information within prescribed time; establishes grounds for rejection of application; authorizes appeal of denial under APA; provides procedures for renewal of license; requires OFR to consider documents from other states as application for licensure in Florida; establishes certain requirements related to practice of debt settlement services; requires debt settlement advisors to establish internal formal complaint process; provides powers of OFR; provides for administrative remedies for violations of act; authorizes OFR to levy civil penalty; authorizes OFR to suspend, revoke, or deny renewal of license under certain circumstances; authorizes debt settlement advisor to appeal suspension or revocation of license under APA; provides for private enforcement of act; provides for award of attorney's fees; provides that violation of act is deceptive & unfair trade practice; provides time limits for commencing civil proceedings.
