CS/HB 1097 (2009) -  Electronic Health Records

Expands access to patient's health records in order to facilitate exchange of data between certain health care facility personnel, practitioners, & providers & attending physicians; eliminates access to patient's health records by State Long-Term Care Ombudsman Council & local long-term care ombudsman councils; creates "Florida Electronic Health Records Exchange Act"; authorizes release of certain health records under emergency medical conditions; provides for immunity from civil liability; provides duties of AHCA with regard to availability of specified information on agency’s Internet website; requires agency to develop & implement universal patient authorization release form; provides penalties; provides for certain compensation & attorney's fees & costs; authorizes AHCA to operate certified electronic health records technology loan fund; requires agency to deposit private donations into trust fund to fund certified electronic health records technology loan fund; requires physicians to provide confirmation of meaningful use of electronic prescribing software in conjunction with licensure renewal; expands access to laboratory reports in order to facilitate exchange of data between certain health care practitioners & providers.
Effective Date: effect upon becoming a law.
