CS/CS/HB 1107 (2009) -  Law Enforcement Officers and Correctional Officers

Provides that officer is entitled to specified rights if officer is subject to suspension in disciplinary proceeding; provides that officer is entitled to review witness statements by other officers & other existing evidence before officer under investigation is interrogated; provides that time-limitation periods will be tolled during disciplinary proceedings under certain specified circumstance; authorizes officer who is subject to investigation & officer's legal counsel to review specified documents & recordings before investigative interview; provides procedures & remedies to officer if agency intentionally fails to comply with specified provisions; provides that officer bears burden of proof to establish intentional violations; provides that standard of proof is preponderance of evidence; exempts specified provisions from Administrative Procedure Act.
