CS/HB 1121 - Clerks of Court

General Bill   by Criminal & Civil Justice Appropriations Committee and Bogdanoff and Thurston
Clerks of Court: Provides for review & approval or disapproval of Florida Clerks of Court Operations Corporation budget & clerks' combined budgets by LBC; requires Supreme Court & AG to jointly enter contract with vendor to publish copies of Florida cases; requires clerk of court to pursue collection of specified fees, service charges, fines, court costs, & liens; revises distribution of certain filing fees; revises membership of executive council of corporation & corporation's duties; revises budget procedures of clerks of court; requires AG to develop study plan & present plan to LBC; requires Technology Review Workgroup to produce plan for determining options for implementing integrated computer system; provides statewide budget cap for clerks of court; provides that corporation & clerks of court are subject to state procurement law; specifies that all court-related fines, fees, service charges, & costs are required to be deposited into Clerks of Court Trust Fund; requires that specified percentage of all court-related fines collected by clerk be deposited into clerk's Public Records Modernization Trust Fund & used exclusively for additional court-related operational needs & programs; revises distribution of filing fees; revises specified clerks of court service charge payments; requires costs of electronic tax deed sales to be added to charges for specified costs of sale & paid by certificateholder; authorizes specified units of local government to increase surcharge or impose alternative surcharge.
