General Bill by Government Accountability Act Council and Van Zant (CO-SPONSORS) Horner; Mayfield; Roberson, Y.; Rogers
Public-Private Partnership Infrastructure Projects: Provides for DMS & state agency or local government to receive or solicit proposals to enter into public works infrastructure project agreement with private entity, or consortium of private entities, to build, operate, or finance public works infrastructure project; provides criteria for selection of project & private entity; requires all reasonable costs to state related to project to be borne by private entity; authorizes private entity to impose user fees for use of infrastructure project; provides financing & revenue criteria for project agreement; requires that each infrastructure facility be in compliance with all applicable federal, state, & local laws, construction standards, & performance standards; authorizes each participating governmental unit to exercise lawful powers to aid in development & construction of project; provides procedures for requesting & considering proposals; authorizes DMS & participating governmental unit to use innovative financing techniques; requires DMS to compile summary of new projects each year; limits term of infrastructure project agreement; provides authority to increase term of project; prohibits public-private infrastructure project agreements with private entities that engage in or benefit from dealings with any terrorist state.
