Creates pt. III, ch. 538, F.S., entitled "Mail-In Secondhand Dealers of Jewelry and Precious Metals"; defines terms; excludes certain persons & businesses from applicability of act; provides registration & recordkeeping requirements; provides for verification of seller's identification; requires seller to present notarized statement to secondhand dealer that photographic identification is true & accurate under certain circumstances; requires seller to provide sworn statement that seller is lawful owner with right to sell; prescribes procedures for deficiencies in information required to be provided by seller; provides holding periods for jewelry & precious metals; provides procedures for returning seller's jewelry & precious metals; provides procedures for notifying law enforcement agency of transactions; prescribes procedures for tendering payments; requires dealer to remit payment under certain conditions; provides for inspection of records & premises by law enforcement agencies; provides holding periods for jewelry & precious metals purchased by secondhand dealer; provides requirements for storage of jewelry & precious metals; describes prohibited acts & practices; provides criminal penalties; provides for cause of action for stolen jewelry & precious metals; provides for petition for return of jewelry & precious metals; provides for filing fees & award of attorney's fees & costs.
