• Planas -
  I vote yes on this bill because the protections against under age drinking are an important state interest. However, it is still my contention that the 250,000 gallon cap will be found unconstitutional. I believe this is a protectionist measure that will harm competition. The Federal Trade Commission agreed and in a letter to Senator Paula Dockery stated that they believed that the cap would significantly harm consumers. It seems ironic that on the 30th anniversary of the tasting of Paris, where American wines from California beat the French wines, we have now made it illegal to ship the wine (Chateau Montelena) that beat the French.
