Revises the definition of "tertiary health service" under the Health Facility and Services Development Act; provides for the level of funding for local health councils; revises provisions relating to health-care-related projects subject to review for a certificate of need; removes certain projects from expedited review and revises requirements for other projects subject to expedited review; removes the exemption from review for certain projects; revises requirements for certain projects that are exempt from review; exempts certain projects from review; increases fees of the certificate-of-need program; provides for approval of recommended orders of the Division of Administrative Hearings when the Agency for Health Care Administration fails to take action on an application for a certificate of need within a specified time period; revises the definition of "resident care plan"; deletes a provision authorizing the overcoming of agency action by a preponderance of the evidence; narrows the responsibilities for a nursing assistant to maintain medical records only for residents who are at high risk for malnutrition or dehydration as ordered by the resident's physician; revises the definition of "adverse incident" to eliminate certain events from the term; revising reporting requirements; revises the agency's authority to enter and inspect a nursing home based on final agency action that a facility has a deficiency cited; requires nursing assistants to meet certain inservice training requirements to maintain certification; revises requirements regarding rules, evaluation and deficiencies, and licensure status of nursing homes; allows nursing homes to convert beds to alternative uses as specified; provides restrictions on uses of funding under assisted-living Medicaid waivers; provides procedures; provides for the applicability of certain fire and life safety codes; provides applicability of certain laws; requires a nursing home to submit to the Agency for Health Care Administration a written request for permission to convert beds to alternative uses; provides conditions for disapproving such a request; provides for periodic review; provides for retention of nursing home licensure for converted beds; provides for reconversion of the beds; provides applicability of licensure fees; requires a report to the agency; creates the Hospital Statutory and Regulatory Reform Council; provides legislative intent; provides for membership and duties of the council.
Effective Date: This act shall take effect July 1, 2003
