With regard to workers' compensation, provides for employer's and carrier's responsibilities for production of documents; requires a written explanation if benefits are denied; provides for waiver of employee confidentiality with regard to medical records and reports; requires certain medical reports to include specified information; provides conditions for independent medical examinations; provides for claims and termination or suspension of claims for medical benefits in compensability admitted cases; provides for requests for authorization of medical treatment or testing in such cases; provides procedures and sanctions when an employees fails or refuses to attend a medical appointment; revises membership of panel to include the Chief Financial Officer; requires the employee to provide certain information in a petition for benefits; specifies circumstances under which attendant care services may be suspended or terminated and provides for notice thereof; establishes procedures for disputes regarding average weekly wage and corresponding compensation rate; revises provisions relating to temporary total disability benefits; provides for notice of termination of benefits and objections thereto; provides conditions for suspension or termination of catastrophic temporary total disability benefits and objections thereto; provides for hearings; requires earned income reports to the Department of Insurance, employer, and carrier; provides conditions for an employee's return to work; provides conditions for termination of temporary partial disability benefits and objections thereto; provides conditions for termination of permanent impairment benefits and objections thereto; provides for hearings; provides conditions for termination of supplemental benefits and objections thereto; provides conditions for termination of permanent total disability benefits and objections thereto; provides for hearings; requires an employee who has applied for social security benefits to notify the employer or carrier within a specified time period; provides procedures in circumstances when a miscalculation of benefits is alleged; requires certain information to be provided with a petition for benefits in cases of death; provides conditions for denial of death benefits; provides circumstances for denial of benefits as a result of the tolling of the statute of limitations; repeals the Employee Assistance and Ombudsman Office; provides for a stay pending criminal investigation and prosecution of workers' compensation fraud; requires additional information to be provided in an answer to a petition for benefits; provides for extension of time by which to file an answer; provides procedures for expedited hearings; provides for mediation conferences; revises provisions relating to procedures for mediation and hearings; provides for state and private mediation conferences; provides that mediators in state mediation conferences be selected by the Chief Judge of Compensation Claims; provides for pretrial hearings; provides for consolidation of specified petitions for benefits; provides procedures relating to discovery; provides procedures for resolving disputes between carriers; provides for applicability of the Code of Judicial Conduct to the Chief Judge of Compensation Claims and deletes references to the Deputy Chief Judge of Compensation Claims; reorganizes the Office of the Judges of Compensation Claims to provide for expiration of the term of the Deputy Chief Judge and the creation of the position of Chief Judge; requires the Chief Judge to report to the Secretary of Management Services; removes an exception regarding who may serve on the nominating commission; provides responsibilities of The Florida Bar with regard to the conduct of the Chief Judge; requires The Florida Bar Rules Committee to promulgate the Workers' Compensation Rules of Procedure; provides conditions for additional rehabilitation temporary total disability benefits, denial of said benefits, and objections thereto.
