Revises provisions relating to workers' compensation; revises provisions that authorize certain officers of a corporation to elect to be exempt from ch. 440, F.S.; removes references to sole proprietors and partners from provisions authorizing election of exemption; revises requirements for notice; provides for the exclusive liability of a carrier or self-insured employer; deletes a mandatory requirement for certification; provides for an employer or carrier to allow an employee to select medical providers; revises requirements for requesting treatment or care; provides requirements for transfer of care; provides notice requirements for access to medical records; revises requirements for independent medical examinations; authorizes a health care provider to file a petition in order to contest the disallowance or adjustment of payment by a carrier; provides for the medical provider to recover costs and attorney's fees; revises requirements for determining reimbursement amounts; restricts a health care provider's right to recover payment for medical fees; requires that a provider file a petition in order to recover such payments; provides for costs and attorney's fees; revises requirements for managed care arrangements; revises requirements for medical benefits; revises the requirements for paying impairment benefits and supplemental benefits; prohibits an employee from receiving supplemental benefits and impairment benefits; increases the limits on the amount of certain benefits paid as compensation for death; increases the period of limitation on filing a petition for benefits; authorizes a civil suit for damages against an employer who unlawfully coerces an employee for a valid claim for compensation; provides that a carrier who engages in unlawful conduct is subject to civil suit; revises procedures for mediations and hearings; provides additional qualifications for members of the statewide nominating commission for judges of compensation claims; removes a requirement that the Office of the Judges of Compensation Claims adopt procedural rules; revises the Rating Law to include within regulated rating organizations those organizations that make and file prospective loss costs; provides for licensed rating organizations to file prospective loss costs, loss data, and other information with the Department of Insurance for approval; provides that the data, statistics, schedules, and other information submitted to the Workers' Compensation Rating Bureau are subject to public disclosure under public records requirements; provides requirements for the review and approval of prospective loss costs filings; provides for changes in premiums based on loss adjustment expenses.
Effective Date: This act shall take effect January 1, 2004
