HB 1761 CS (2003) -  Child Support

Equates administrative child support orders with court support orders for purposes of chapter 61; deletes the requirement that a child support order include the minor’s social security number; requires the clerk of the court to establish an account for interstate cases; continues increase in depository fee charged by clerks of the court for voluntary use of depository; provides venue for administrative hearings; permits voluntary acknowledgements of paternity which are witnessed; authorizes DOR to adopt rules to administer the withholding of insurance payments; requires notice to the noncustodial parent in applying an undistributable support collection to another support order; provides for DOR to establish the obligation of support; permits noncustodial parents to request that DOR proceed in circuit court to determine the support obligation and revises the requirements under which noncustodial parents may petition the circuit court to determine a support obligation; provides that DOR is a party to court action only with respect to issues of support; provides for the recovery of fees in liquidating securities for the support owed; provides for withholding insurance payments for unpaid support and creates a lien on proceeds; provides for direct payment to DOR by the insurer; permits the use of any legal means of service of process; revises the definition of noncooperation or failure to cooperate as applied to an applicant for or a recipient of public assistance; revises the manner of reimbursement to the clerk of the court for court filings in Title IV-D cases; requires workers’ compensation insurer to inquire about unpaid child support; requires the judge of compensation claims to obtain information on the support owed; permits voluntary acknowledgements of paternity which are witnessed.
Effective Date: Except as otherwise provided herein, this act shall take effect upon becoming a law
