General Bill
Long-Term Care Services:
Provides that certain prior offenses shall be considered in conducting employment screening; requires applicants for licensure as a nursing home to provide proof of a legal right to occupy the property; delineates the types and number of deficiencies justifying denial, revocation, or suspension of a license as an assisted living facility; provides an alternative method of providing notice to an assisted living facility or adult day care center that a license must be renewed; provides that administrative fines for assisted living facilities or its personnel shall be imposed by the AHCA in the manner provided in ch. 120, F.S.; provides for deposit of civil monetary fines in the Quality of Long-Term Care Facility Improvement Trust Fund and authorizes additional expenditures from the fund; provides for enforcement of minimum nursing home staffing standards within a range; allows reviewed financial statements to be submitted for the Gold Seal Program; revises training and education requirements of the Department of Elderly Affairs for assisted living facilities; deletes a requirement that fees for training and education programs be based on the percentage of residents receiving monthly optional supplementation payments; requires the AHCA and the DOH to seek and implement a Medicaid home and community-based waiver for persons with Alzheimer's disease; requires that the AHCA provide advance notice to an adult family-care home that a license must be renewed; reinstates provisions governing background screening of persons involved with health care services pools; exempts nursing homes and continuing care facilities from certain financial reporting requirements; provides that the AHCA is not required to evaluate financial reports of nursing homes; requires that the AHCA licensees pay or arrange for payment of amounts owed to the agency by the licensee prior to transfer of the license or issuance of a license to a transferee.
