General Bill
Insurance Fraud:
Requires an additional fee for offenses relating to false or fraudulent motor vehicle insurance claims or health care patient brokering; specifies additional circumstances for mandatory revocation of a driver's license by the Department of Highway Safety and Motor Vehicles; specifies additional acts constituting grounds for disciplinary actions against health care professionals; authorizes the Division of Insurance Fraud to adopt rules for reporting suspected fraudulent activity; requires the division to develop and maintain a World Wide Web site for specified purposes; authorizes the division to deposit revenues from criminal or forfeiture proceedings into the Insurance Regulatory Trust Fund, specifies accounting and use requirements, provides for appropriation of such revenues, and provides for carrying forward moneys remaining in the fund each year; requires insurers to provide a notice to insureds or persons for whom reimbursement claims are filed; revises provisions specifying what constitutes a material omission and insurance fraud; prohibits organizing, planning, or participating in a scheme to create documentation of a nonoccurring motor vehicle crash; applies a criminal penalty to activities relating to false or fraudulent proof of motor vehicle insurance; specifies nonapplication to law enforcement investigative actions of provisions relating to evidence of intent to defraud a health care provider; specifies an additional circumstance of prohibited patient brokering; revises the definition of "health care provider or health care facility"; includes officers of the Department of Financial Services among a list of personnel for which a criminal penalty is provided for falsely personating such personnel; provides for deposit of proceeds seized by the division into specified trust funds; repeals a provision providing for the future repeal of the Florida Motor Vehicle No-Fault Law.
