HB 1061 (2006) -  Unlawful Operation of a Motor Vehicle

Creates the "Michael Haligowski Memorial Traffic Safety Act"; authorizes court to withhold adjudication of certain violations related to driving without a valid license; requires a written judgment signed by the judge and recorded by the clerk for cases involving driving without a valid license; requires defendant's social security number and fingerprints be affixed to the judgment; prohibits operation of a motor vehicle in violation of ignition interlock device restrictions; provides for an evidentiary presumption of prior convictions; requires certain information to be included with notice to a person whose driver license or driving privilege is being canceled, suspended, revoked, or disqualified; requires the Department of Highway Safety and Motor Vehicles to make driver license status information available to the public through the Internet and a phone system; provides for application of certain penalty provisions to a person whose driver license or driving privilege has been disqualified; revises penalty provisions for driving without a valid license or knowingly driving while driver license or driving privilege is canceled, suspended, revoked, or disqualified for specified alcohol-related or drug-related convictions or refusal to submit to certain testing; requires notice provisions in a cancellation, suspension, revocation, or disqualification by the department or a uniform traffic citation; revises penalty provisions for a habitual offender driving while his or her license is revoked; revises circumstances for application of specified penalties for certain careless or negligent driving offenses; provides for penalties for knowingly aiding a person whose driver license or driving privilege is canceled, suspended, revoked, or disqualified by providing or authorizing the use of a vehicle; requires an officer stopping a vehicle being driven by a person whose driver license or driving privilege is canceled, suspended, revoked, or disqualified to impound or immobilize the vehicle; provides for impoundment and immobilization of the vehicle by the department; provides for such vehicle found operating on any street or highway to be seized and subject to forfeiture; revises penalties imposed on a person who drives a vehicle when that person's driver license has been permanently revoked; directs the department to inform certain drivers and the motoring public of the provisions for impoundment and immobilization.
