HB 1521 CS (2006) -  Children in Out-of-Home Placements

Children in Out-of-Home Placements: Provides that a court must be provided with a name and location of an individual who might be considered for placement of a child; deletes requirement to use diligent efforts to locate an adult relative to care for a child; provides a standard for changing the custody of a child; provides for an evidentiary hearing when there is an objection to the placement of a child and factors a court must consider in determining a change of placement to a person other than a parent; provides for consideration of certain factors in determining whether the best interest of the child will be served by transfers custody of the child when the child has resided in the same out-of-home placement for more than 1 year; requires that an administrative hearing be conducted by an administrative law judge assigned by the Division of Administrative Hearings in cases involving children with developmental disabilities.
