HB 7241 CS (2006) -  Florida Workers' Compensation Joint Underwriting Association

Requires the joint underwriting plan of insurers to operate as the Florida Workers' Compensation Joint Underwriting Association; revises the membership and duties of the board of governors relating to the operation of the joint underwriting plan; provides for continuous review of the plan; authorizes the Office of Insurance Regulation to withdraw approval of the plan under certain circumstances; requires the periodic review and update of the market-assistance plan; provides requirements and procedures for procurement of goods and services; prohibits the retention of certain lobbyist services; provides requirements for legal services; authorizes certain employees to provide lobbyist services; authorizes the use of certain subplan surplus funds; extends the deadline to levy deficit assessments; requires the board to request the transfer of funds from the Workers' Compensation Administration Trust Fund under certain circumstances; requires that the plan be subject to certain filing and approval rates and rating plan requirements; deletes certain provisions limiting the disapproval of rates by the Office of Insurance Regulation; requires that excess funds received by the plan be returned to the state; provides applicability of specified statutes regulating ethical standards; requires certain disclosure statements for plan employees; prescribes limits on certain representation by former plan employees; prohibits a private individual's ability to benefit from the plan's income; prohibits employees and board members from accepting gifts or expenditures from persons and entities with certain relationships to the plan; provides applicability; requires the Office of Insurance Regulation to perform periodic comprehensive market examinations; prescribes disposition of assets of the plan upon dissolution; provides exemption from the corporate income tax; provides for the payment of premium taxes; allows the contingency reserve to be used to fund certain deficits; extends the period for maintaining the contingency reserve and projecting current cash needs; requires the plan to submit a request for an Internal Revenue Service letter determining the plan's eligibility as a tax-exempt organization.
