Legal Representation for Indigent Persons: Moves responsibility for appointment of attorneys from courts to public defenders; limits expenditures; provides contract requirements; repeals indigent services committees; provides additional duties for public defenders related to attorney services in certain cases; requires reports; revises requirements for payment for costs of representation; changes trust fund name; provides that public defender investigators are authorized to act in any judicial circuit; revises provisions relating to conflict cases; creates financial penalties for attorneys providing ineffective assistance; provides for amendment of standard fee in GAA; allows for extraordinary payment; allows public defender achieving cost savings portion of savings; revises provisions for removal of attorneys from attorney registry; provides that public defender is chief administrator of all indigent services in circuit; provides that appointed attorneys have same access to prisoners as public defender; moves responsibility for deficit in contingency fund; requires establishment of peer review committee; limits expenditures for due process costs; provides for appointment of attorney for alleged incapacitated person; repeals specified requirement for payment of costs for indigent criminal defendant; provides for lien against individual who has been provided attorney services as indigent & directs payment of moneys collected from lien; creates transitional plan for expenses; requires report from public defenders.
