CS/HB 7103 (2009) -  Mental Health

Creates Community Mental Health & Substance Abuse Treatment & Crime Reduction Act; requires DCFS, in consultation with AHCA, to develop & implement community mental health & substance abuse forensic treatment system; provides initiatives & strategies for community forensic system; details services; requires DCFS to develop continuum of services; authorizes pilot sites where community mental health & substance abuse forensic treatment system will be implemented; requires county councils to consult with local government when planning or implementing act; adds home & community-based mental health services to optional Medicaid services; allows exemption for persons who have serious & persistent mental illnesses receiving services under act from MediPass & managed care plans; specifies treatment procedures for client admitted to state forensic mental health treatment facility lacking capacity for informed decisionmaking; provides for forensic evaluator training for mental health experts; requires DCFS to maintain & annually provide courts with forensic evaluator registry; provides time frames for competency & commitment hearings to be held.
Effective Date: July 1, 2009, only if a specific appropriation to fund the provisions of this act is made in fiscal year 2009-2010
