Creates City of Marion Oaks; provides powers, form of government, & corporate boundaries; provides for appointment, powers, duties, eligibility, & compensation of city council, including mayor & deputy mayor; provides meeting requirements; provides appointment, qualifications, compensation, & powers & duties of city manager & acting city manager; provides for appointment & duties of city attorney & city clerk; provides for financial management; specifies budget requirements; provides for oversight & audit; requires capital program; provides for districting committee & procedures for division of city into districts; provides for initial election of mayor & council members; provides voter authority to propose initiatives, referenda, & recall of officers; provides procedures for filing & circulating petitions; provides for elections with respect to proposed initiative or reconsidered ordinances; provides ethics requirements for officers & employees; provides for charter review & amendment; provides for initial expenses & transitional ordinances & continuation of certain revenue sources & municipal services; provides severability; provides for referendum.
Effective Date:
upon its approval by a majority vote of those registered electors residing within the proposed corporate limits of the proposed City of Marion Oaks, as described in subsection (6) of section 1, voting in a referendum election to be called by the Marion County Supervisor of Elections and to be held on August 24, 2010, in accordance with the provisions of law relating to elections currently in force, except that this section shall take effect upon becoming a law
