HB 1077 (2010) -  Mobile Home Park Lot Tenancies

Authorizes court to refer actions to binding arbitration; provides that arbitration decision may be made known to judge in trial de novo prior to judge entering his or her order on merits; revises provisions relating to grounds & proceedings for eviction to provide for nonapplicability of certain provisions to certain persons approved for payment by Florida Mobile Home Relocation Corporation; revises provisions relating to relocation expenses; revises payment amounts mobile home owners are entitled to from corporation under certain circumstances; increases amounts mobile home owners abandoning their mobile homes may collect from corporation; requires mobile home park owners receiving bona fide offer for purchase to notify officers of homeowners' association; authorizes time extension for home owners when park owner changes terms & conditions of offer to purchase park; revises requirements with respect to unsolicited offers; provides homeowners' association with right of first refusal to purchase park in event of unsolicited offer; encourages mobile home owners to organize as homeowners' associations to negotiate right of first refusal; redefines term "offer" for such purposes; provides limitation on exception relating to transfers by partnerships; revises procedures providing for removal or relocation of mobile home owners.
