Smoking in Vehicles with Minor Passengers: Provides for enhanced penalties for any moving or nonmoving violation committed by person driving or in control of motor vehicle while person in vehicle is smoking when minor is in vehicle, regardless of whether vehicle is in operation or parked; provides that officer may issue warning to violator; provides that officer may elect to distribute specified materials; provides that enforcement must only be secondary action when driver of motor vehicle has been detained for another violation of specified provisions; provides that no enhanced penalty may be assessed for violations committed before specified date.
