General Bill
State Financial Matters:
Prohibits agency or branch of state government from contracting, without legislative authority, to pay liquidated damages or early termination fees resulting from breach or early termination of contract or agreement, to pay interest because of insufficient budget authority to pay obligation in current year, from obligating state to make future payments to cover unpaid balances, or from granting to party right to collect fees or other revenues from nonparties; requires executive & judicial branch to notify Governor & Legislature before entering into contracts or agreements in excess of certain amount, which authorize expenditures in anticipation of revenues, or for which payment is delayed for certain time after expenditure; requires contract for proposed outsourcing by state to disclose contractor's CEO compensation & executive compensation packages; requires contract for proposed outsourcing by state to prohibit contractor from authorizing automatic increase in salary or benefits of employee of contractor if employee is providing activity or service under such contract; provides requirements & procedures for approval of such increase; requires OPPAGA to submit annual report; prohibits certain lease or deferred-payment purchases by state agencies & certain master equipment financing agreements unless expressly authorized in appropriations act.
Effective Date:
July 1, 2010, and applies to initial contracts and agreements, amendments to a contract or agreement, and extensions or renewals of a contract or agreement which are executed on or after that date
