CS/HB 7181 (2010) -  Juvenile Justice

Makes children 9 years of age or younger at time of referral for delinquent act eligible for comprehensive mental health services; encourages prearrest or postarrest diversion programs for first-time misdemeanor offenders or offenders 9 years of age or younger; requires probation officer to make referral to appropriate shelter if risk assessment shows child is ineligible for secure detention; prohibits placing child in detention care because of misdemeanor charge of domestic violence in certain circumstances; prohibits placing child 9 years of age or younger in secure detention; provides exceptions; provides that child may be retained in home detention care; provides that child who is charged with felony domestic violence & not meeting detention criteria may be held in secure detention if certain findings are made; provides that court may commit female child to mother-infant program; specifies that child working in certain circumstances is state employee for workers' compensation purposes; revises provisions relating to quality assurance & cost-effectiveness of DJJ programs.
