SB 1810 (2012) -  Driving a Motor Vehicle While Impaired

Providing that a person commits the offense of driving while impaired and is subject to punishment for such violation if the person is driving a motor vehicle and satisfies the specified criteria relating to the consumption of alcohol, controlled substances, or other impairing substances; providing that a person is entitled to an affirmative defense to the offense of driving while impaired if the person charged with the offense of driving while impaired introduced a controlled substance into his or her body pursuant to a prescription issued by a licensed health professional who is authorized to prescribe the controlled substance and if the person consumed the controlled substance in accordance with the health professional’s directions; providing that the use of a nonprescribed substance does not constitute an affirmative defense for a person who has a prescription for another substance, etc.
