HB 871 -  Driving Under the Influence

Prohibits trial court judge from accepting specified pleas when person is charged with DUI; requires person to be told that failure to submit to breath or urine test is second degree or first degree misdemeanor; classifies person's refusal to submit to breath or urine test as second degree or first degree misdemeanor; authorizes judicial circuits to create DUI diversion program; requires policies & procedures to be published on state attorney's website; requires each judicial circuit operating such program to submit information to DHSMV for persons who successfully complete program; requires DHSMV to notate successful completion on driving record; provides ineligibility for future participation in program; prohibits court from suspending, deferring, or withholding adjudication of guilt or imposition of sentence for specified violation.
