HB 989 CS (2003) -  Controlled Substances

Provides additional requirements for the dispensing of a controlled substance listed in Schedule II, Schedule III, or Schedule IV; provides rulemaking authority to the Board of Pharmacy; requires the Department of Health to establish an electronic system to monitor the prescribing of controlled substances listed in Schedules II, III, and IV; requires the dispensing of such controlled substances to be reported through the system; provides exceptions; provides reporting requirements; provides penalties; provides rulemaking authority to the department; requires the department to cover all costs for the system; provides a continuing appropriation; requires the department to develop and adopt by rule the form and content for a counterfeit-resistant prescription blank for voluntary use by physicians to prescribe a controlled substance listed in Schedule II, Schedule III, or Schedule IV; prohibits the sale, manufacture, alteration, delivery, uttering, or possession of counterfeit-resistant prescription blanks for controlled substances; provides an appropriation; provides contingent applicability of penalties.
Effective Date: Except as otherwise provided herein, this act shall take effect July 1, 2004, if House Bill 997 or similar legislation is adopted in the same legislative session or an extension thereof and becomes law
