HB 1345 CS (2003) -  Services for Deaf Persons and Blind Persons

Creates the Florida Council on Deafness; provides membership and organization of the council; provides role, purpose, powers, duties, and responsibilities of the council; creates the Florida Commission for the Blind in the Department of Education; provides membership, powers and duties, and meetings of the commission; provides for administrative support by the department; provides that the commission is the agency head of the Division of Blind Services; provides that the division is the designated state unit under the federal Rehabilitation Act of 1973; provides that the division is a separate budget entity; provides for an executive director of the commission, who is also chief administrative officer of the division; provides for the executive director to employ personnel; requires the division to develop and implement a state plan for vocational rehabilitation services; requires the division to develop and implement a state plan for independent living services; provides for the division to purchase and distribute specialized equipment without using state centralized purchasing procedures; exempts such equipment from certain record and inventory requirements; creates a children's program; requires an annual report by the commission; provides for dispute resolution; provides that members of the Florida Commission for the Blind are not appointed by the Commissioner of Education; provides legislative purpose and policy; provides duties of the commission and the division; eliminates division authority to recommend personnel; prescribes principles for commission activities; provides definitions; requires background investigations of commission personnel; repeals the Advisory Council for the Blind; provides budgetary procedures for the commission; provides duties of the executive director of the commission; provides for management flexibility in the division's allocation of funds and the amendment of authorized positions; requires the commission to maintain records; provides for the division to retain title to certain real and personal property intended for use by people who have visual impairments and certain commission personnel; allows the division to repossess, transfer, and dispose of such property; provides for rulemaking by the commission; authorizes the commission to create a blind services direct-support organization; provides purposes and objectives; provides for members of board of the direct-support organization; provides that the organization is subject to public records and public meeting requirements; requires expenses of the organization to be paid by private funds; provides guidelines for the use of the funds; amends various provisions to conform to changes made by the act; provides that the act does not modify status of certain employees; repeals provisions relating to the issuance of permits for soliciting funds on behalf of blind persons.
Effective Date: This act shall take effect July 1, 2003
