HB 849 CS (2004) -  Wekiva Study Area and the Wekiva Parkway

Creates pt. III, ch. 369, F.S., the Wekiva Study Area and Wekiva Parkway Act; provides for construction of the parkway; requires acquisition of right-of-way prior to construction; authorizes DOT to exercise eminent domain with regard to identified lands; provides that title to lands acquired shall vest in the state; provides for transfer of certain lands not needed for the parkway to the Board of Trustees of the Internal Improvement Trust Fund; requires cooperation and establishment of funding responsibilities and partnerships between certain land-acquisition entities; requires certain studies relating to water quality and wastewater treatment standards to be conducted by DEP, DOH, and DACS; requires the St. Johns River Water Management District to initiate rulemaking with regard to recharge criteria; requires the district to provide certain information and establish certain goals with regard to Rock Springs, Wekiwa Springs, and the Wekiva Study Area; requires DEP to conduct a study of the effect of septic tanks on specified waterways; requires reports; requires local governments within the Wekiva Study Area to develop a master stormwater management plan and a water reuse and irrigation program; requires local governments in specified areas to develop a wastewater facility plan; requires local governments to amend their comprehensive plans; provides for coordination of land use and water supply within the Wekiva Study Area; requires DCA to review comprehensive plans and amendments thereto for compliance; creates the Wekiva River Basin Commission; provides that the East Central Florida Regional Planning Council, in coordination with applicable regional and state agencies, shall serve as a clearinghouse of baseline or specialized studies; establishes a New Garden Coal mitigation bank.
