HB 1135 (2004) -  Cargo Chassis

Defines "ocean marine terminal" and "intermodal chassis" or "chassis"; requires the inspection, tagging, quarantine, and repair of cargo chassis that fail to pass described roadability inspections; provides for inspection of chassis in lieu of inspections required for motor carriers or motor vehicles; provides for application; prohibits ocean marine terminal operators to tender to or interchange with a motor carrier an intermodal chassis that fails to pass inspection; requires certification that the chassis has passed inspection; provides penalties for violation; provides that the inspection requirement is in addition to specified annual inspection; requires routine chassis inspections prior to placement of container on the chassis and prior to release for operation; requires daily records of the inspections; provides for form and content of such records; requires specified identification and separation of chassis that pass and fail the inspection; provides for tags to identify whether a chassis has passed or failed the inspection; authorizes a driver to request reinspection of chassis under certain circumstances; provides procedures; provides for compensation of the driver; prohibits retaliation against the driver; provides procedures and remedies for violation; requires records of reinspection requests; provides for content of such records; authorizes driver to contact law enforcement agency in lieu of making such reinspection request; provides for maintenance and availability of records; requires DOT and DHSMV to conduct onsite reviews to determine compliance; provides procedures for noncompliance; provides procedures for inspection results indicating imminent danger to the public; authorizes Florida Highway Patrol officers and other law enforcement officers to enter premises and perform inspections; provides for citation of violations; provides penalties for such citations; provides for defect in and voidability of contracts; authorizes DOT and DHSMV to adopt rules; provides for applicability of act to safe driving laws.
