HB 1775 (2004) -  Public Guardianship

Provides that guardian advocates are not required to file annual accountings; deletes a requirement for background screening; requires the Statewide Public Guardianship Office to receive and review credit and criminal investigations prior to registering a professional guardian; authorizes the executive director of the office to deny registration; authorizes circuit courts to appoint guardian advocates; requires the clerk of the court to provide copies of credit and criminal investigations of public and professional guardians to be maintained with their files; requires a direct-support organization to operate under written contract with the office; requires the Secretary of Elderly Affairs to appoint a board of directors for the direct-support organization; authorizes the Department of Elderly Affairs to allow the use of department facilities and property by the organization; authorizes the organization to hold moneys in a separate account; requires an annual audit; authorizes judicial dissolution for corporations fraudulently representing themselves as direct-support organizations; creates the Joining Forces for Public Guardianship matching grant program; provides for distribution of grant funds; provides limitations on awards; provides requirements for disbursement of grant funds to prior awardees; requires grant funds to be used for a certain purpose; provides that program implementation is subject to specific appropriation; requires the office to administer the grant program; provides eligibility requirements to receive grant funding; requires matching funds from local funding sources.
