HB 177 (2005) -  Drug Court Programs

Provides additional legislative purposes and intent with respect to the treatment of substance abuse, including the use of the drug court program model; authorizes the court to require certain persons to undergo treatment following adjudication; authorizes the court to order specified persons to submit to a substance abuse assessment upon a showing of good cause in connection with a petition for shelter or dependency or an adjudicatory order or pursuant to a disposition hearing; authorizes the court to require participation in a treatment-based drug court program; authorizes the court to impose sanctions for noncompliance; authorizes the court to extend the time for completing a case plan during judicial review, based upon participation in a treatment-based drug court program; revises legislative intent with respect to treatment-based drug court programs to reflect and encourage additional participation; includes postadjudicatory programs as part of treatment-based drug court programs; provides requirements and sanctions, including clinical placement or incarceration, for the coordinated strategy developed by the drug court team to encourage participant compliance; requires judicial circuits to establish coordinator positions for the treatment-based drug court program, subject to annual appropriation by the Legislature; authorizes the chief judge of each judicial circuit to appoint an advisory committee for such program and provides for membership of the committee; revises language with respect to conditions for the transfer of a case in the drug court treatment program to a county other than that in which the charge arose; revises provisions relating to pretrial substance abuse education and treatment intervention programs to conform to changes made by the act.
