HB 631 (2005) -  Provision of Health Care Services

Prohibits health insurer and health maintenance organizations from demanding repayment of an overpayment made due to error of the health insurer or health maintenance organization; reduces a period of time for a claim for overpayment; requires a health insurer or health maintenance organization to pay, and prohibits denial of, claims for treatment; authorizes certain aggrieved persons to bring actions for violations; provides for recovery of amounts, interest, attorney fees, and court costs, with limits; requires attorneys to submit affidavits for fees; provides for awards of fees or costs to become a part of the judgment and subject to execution; prohibits health maintenance contracts from prohibiting or restricting subscribers from assigning plan benefits to noncontract physicians for services; requires recognition of the assignment and payment of services; provides requirements for physicians accepting such assignments; revises required contract termination provisions; revises provisions for reimbursement of noncontract providers.
