HB 645 (2005) -  Department of Law Enforcement

Requires the Florida Department of Law Enforcement to review other records in addition to criminal history records to evaluate a potential buyer or transferee of a firearm, including an adjudication of mental defectiveness or a commitment to a mental institution as criteria that prohibit a person from purchasing a firearm; requires the department to maintain an automated database of persons who are prohibited from purchasing a firearm; requires each clerk of court to submit certain court records to the department within a certain period; requires the department to delete certain records from the automated database upon the request of an individual meeting specified conditions; authorizes the department to disclose collected data to other federal or state agencies with regard to the sale or transfer of a firearm; authorizes the department to disclose certain information to the Department of Agriculture and Consumer Services for determining eligibility of an applicant for a concealed weapons or concealed firearms license; requires the clerk of court or mental hospital to provide additional information upon request following an appeal of an unapproved sale or transfer of a firearm; provides for recertification for protective services for an additional period, with reimbursement for expenses from the Victim and Witness Protection Review Committee; provides for unlimited protective services for a victim or witness without reimbursement; provides immunity to the department, other law enforcement agencies, and media representatives from civil liability for complying in good faith with a request to record or report information of an Amber Alert or Missing Child Alert; provides that a technical or clerical error or incorrect or incomplete information does not overcome the presumption of good faith in reporting information about an Amber Alert or Missing Child Alert; requires that disposition reports for dispositions relating to minor offenders are mandatory after a specified date; requires a set of fingerprints as part of a name change petition; authorizes the department to retain fingerprints in certain circumstances and use retained fingerprints for certain purposes; provides for an annual fee; requires the department to make certain information available to judges; authorizes a criminal justice agency to obtain a criminal history background check of a noncertified agency employee by submitting fingerprints to the department; requires that the criminal history check be provided by the department in certain circumstances; revises numerous provisions relating to expunction or sealing of a criminal history record; prohibits a person from denying arrests covered by his or her sealed criminal record when attempting to purchase a firearm; provides that a person who is seeking authorization for employment within or access to a seaport may not deny or fail to acknowledge arrests covered by sealed records; provides circumstances under which the department may acknowledge sealed criminal history records; requires the department to enter fingerprints into a statewide automated fingerprint identification system; requires the department to search each arrest fingerprint card received against fingerprints retained in the statewide automated fingerprint identification system; provides for refingerprinting by a certain date; repeals provisions relating to an annual financial audit of criminal justice selection centers; authorizes the Criminal Justice Standards and Training Commission and the advisory board of a criminal justice selection center to inspect and copy documents; requires the department to investigate all public assistance that is provided by the state; requires public assistance recipients to consent in writing to an investigation into their employment and financial histories; requires the department to report the results of investigations to the Agency for Workforce Innovation; authorizes the department to purchase goodwill and promotional materials; limits the annual amount of such expenditures; prohibits the unauthorized use of the department's emblems and names.
