HB 1827 CS (2005) -  Department of Children and Family Services

Provides legislative intent with respect to establishing a structure by which the department shall monitor and manage contracts with external service providers; requires the department to competitively procure commodities and contractual services; requires the department to allow all public postsecondary institutions to bid on contracts intended for any public postsecondary institution; authorizes the department to competitively procure and contract for systems of treatment or service that involve multiple providers; provides requirements if other governmental entities contribute matching funds; requires that an entity providing matching funds must comply with procurement procedures; authorizes the department to independently procure and contract for treatment services; requires the department to develop a validated business case before outsourcing any service or function; provides requirements for the business case; requires that the validated business case be submitted to the Legislature for approval; requires that a contractual service that has previously been outsourced be subject to the requirements for a validated business case; requires that a procurement of contractual services equal to or in excess of the threshold amount for CATEGORY FIVE comply with specified requirements, including a scope of work and performance standards; authorizes the department to adopt incremental penalties by rule; authorizes the department to include cost-neutral, performance-based incentives in a contract; requires multiyear contracts; requires that a contract in excess of $1 million be negotiated by a contract negotiator who is certified according to standards established by the Department of Management Services; limits circumstances under which the department may amend a contract; requires that a proposed contract amendment be submitted to the Executive Office of the Governor for approval; requires approval of a contract amendment by the Administration Commission; requires the department to verify that contractural terms have been satisfied before renewing a contract; requires documentation; requires the department to develop, in consultation with the Department of Management Services, contract templates and guidelines; requires that the department establish a contract-management process; specifies the requirements for and components of the contract-management process; provides requirements for resolving performance deficiencies and terminating a contract; requires a corrective-action plan; requires the department to develop standards of conduct and disciplinary actions; requires the department to establish contract-monitoring units and a contract-monitoring process; prohibits contractors from engaging in specified activities; requires written reports; requires on-site visits for contracts involving the provision of direct client services; requires the department to make specified documents available to the Legislature; requires the department to create an electronic database to store the documents; requires the Agency for Persons with Disabilities to implement systems to ensure quality and fiscal integrity of programs in the developmental services Medicaid waiver system; provides an exemption for health services from competitive bidding requirements; requires the Office of Program Policy Analysis and Government Accountability to conduct two reviews of the contract-management and accountability structures of the department and report to the Legislature and the Auditor General; repeals provisions relating to contract-management requirements for the Department of Children and Family Services; provides an appropriation.
