HB 1863 CS (2005) -  Juvenile Justice

Revises definitions relating to juvenile justice; creates the minimum-risk nonresidential restrictiveness level; provides an additional way that high-risk residential facilities may be secured; removes juvenile prisons from a the maximum-risk residential level; provides for temporary release from residential commitment facilities; provides that a child may be taken into custody for absconding from a nonresidential commitment facility; provides for a child to be taken into custody upon specified court findings; provides secure detention for children awaiting minimum-risk placement who violate home or nonsecure detention or electronic monitoring; provides the maximum length for a minimum-risk nonresidential commitment for a second degree misdemeanor; provides that the Department of Juvenile Justice or a provider report quarterly to the court the child's treatment plan progress; requires parents to pay fees for costs of supervision related to minimum-risk nonresidential commitment; provides for assessment of residentially committed youth for conditional release services; requires the department to create a task force on juvenile sexual offenders and their victims; requires the department to establish a task force to study certification of professional staff working for a provider of juvenile justice services; requires written orders granting or denying specified transfers for committed youth; requires juvenile justice county councils to develop criteria for law enforcement referrals to juvenile assessment centers; provides for representation on juvenile justice county councils or circuit boards.
