HB 1881 CS (2005) -  Development of Water Supplies

Creates definitions for "alternative water supply," "capital costs," and "multijurisdictional water supply entities"; provides for the development of regional water supply plans; provides requirements for the content of each plan; provides for an approval process for the plans; provides for annual updates; provides for local government use of the plans; provides notification requirements for water management districts concerning findings within the plan; changes the deadline for certain plan updates; encourages cooperation in the development of water supplies; provides for alternative water supply development; encourages municipalities, counties, and special districts to create regional water supply authorities; establishes the primary roles of the water management district in alternative water supply development; establishes the primary roles of local governments, regional water supply authorities, special districts, and publicly owned and privately owned water utilities in alternative water supply development; provides general powers and duties of the water management districts in water production; requires that the water management districts include the amount needed to implement the water supply development projects in each annual budget; establishes general funding criteria for funding assistance to water management districts; establishes economic incentives for alternative water supply development; requires that funding assistance for alternative water supply development be limited to a percentage of the local capital costs of an approved project; requires that the governing board or alternative water supplies advisory committee recommend alternative water supply projects for funding; establishes criteria; provides for cost recovery from the Public Service Commission; establishes criteria for funding assistance for water reuse systems; clarifies that counties, municipalities, and special districts may execute interlocal agreements to create regional water supply authorities; prohibits certain transfers of water; establishes criteria for certain water supply entities to be presumed to have a use consistent with the public interest for requirements for consumptive use permitting; provides permits of at least 20 years for development of alternative water supplies under certain conditions.
Effective Date: upon becoming a law.
