Clarifies that a criminal record that relates to certain offenses may not be expunged, regardless of whether adjudication was withheld, if the defendant was found guilty of or pled guilty or nolo contendere to the offense; clarifies that a criminal record that relates to certain offenses may not be sealed, regardless of whether adjudication was withheld, if the defendant was found guilty of or pled guilty or nolo contendere to the offense; provides that a certificate of eligibility for sealing is available if the person seeking the certificate has never secured a prior sealing or expunction of a criminal history record under specified provisions involving an offense for which he or she was found guilty or pled guilty or nolo contendere.
Effective Date: upon becoming a law.
