HB 7231 (2006) -  Compensation for Wrongful Incarceration

Provides that a person who has been wrongfully convicted of a felony offense and incarcerated within the Department of Corrections as a result of that conviction may be financially compensated if determined to be actually innocent; defines the term "actually innocent"; provides conditions which constitute ineligibility for compensation under the act; requires that the claimant submit specified documents to the Department of Legal Affairs as proof of eligibility for compensation; provides procedures and requirements of the department with respect to the examination and review of a claim; provides criteria for payment of a claim by the Chief Financial Officer; provides for forfeiture and reversion of unpaid amounts under specified circumstances; provides for legislative redress of disputes; requires an executed release and waiver as a condition precedent to tender of payment; provides requirements of the Chief Financial Officer with respect to the processing and payment of a claim; provides that payment shall be made pursuant to specific appropriation provided to the Department of Legal Affairs; provides legislative intent with respect to such appropriations; provides for waiver of specified tuition and fees for claimants compensated under the act; provides requirements with respect to educational benefits; provides that the Legislature is not deemed to have waived any defense of sovereign immunity nor increased the limits of liability as a result of the act or the payment of a claim thereunder; provides legislative intent with respect to amounts awarded under the act; authorizes the Legislature to make an official apology.
