HB 183 (2007) -  Blood Testing of Persons Involved in a Traffic Accident Causing Serious Injury or Death

Requires law enforcement officer who has reasonable suspicion that person was driving or in actual physical control of motor vehicle involved in accident that may have caused or contributed to death or serious bodily injury of human being to require that person to submit to test of person's blood to determine alcoholic content thereof or presence of specified substances; authorizes law enforcement officer to use reasonable force if necessary; requires that blood test be performed in reasonable manner; provides that test need not be incidental to lawful arrest of person.
Effective Date: July 1, 2007.
