HB 721 (2008) -  Admissibility of Statements of a Criminal Defendant in Felony Cases

Requires hearsay statements made during custodial interrogations to comply with specified requirements to be admissible; describes circumstances in which oral, written, or sign-language statement made by interrogee during custodial interrogation is presumed inadmissible as evidence against such person; describes circumstances in which prosecution may rebut such presumption; describes circumstances in which law enforcement officers may have good cause not to electronically record all or part of interrogation; provides for admissibility of certain statements made in certain proceedings or obtained by federal officers or other officers; provides for preservation of electronic recordings; provides for admissibility of certain statements; requires that for hearsay statement against interest made during custodial interrogation to be admissible when declarant unavailable specified requirements must have been complied with; provides finding of important state interest & purpose.
